Planned Parenthood's HB 195

HB 195 plays neatly into Planned Parenthood‘s hands – and Alaskans will no doubt understand that a vote to override Governor Dunleavy’s veto is just part of the plan.

On June 10th, Planned Parenthood sued Alaska to remove the AS 18.16.010(a)(2) “hospital/approved facility rule” so that they could perform “telehealth” abortions and mail abortion pills across Alaska.

But wouldn’t it be easier, quicker, and cheaper to just send their abortion pill prescriptions to local pharmacies instead of packaging the pills and paying overnight or express delivery fees?

With the imminent injunction against that “hospital/approved facility rule,” Planned Parenthood and independent abortionists will be able to use pharmacies as Amazon lockers for abortion pills – the abortion pill prescription can be written anywhere in America, sent to any participating pharmacy, and in hours – not days – a pregnant mother can abort her baby virtually anywhere in Alaska.

And there is no doubt that Alaska’s courts will issue the requested “preliminary and permanent injunction” since this case is a carbon copy of the 2024 “physician only rule,” case that opened abortions to nurse practitioners, certified midwives, and physician assistants.

Worse – if it can get worse – HB 195 creates Collaborative Practice Agreements (CPAs) that allow prescribers (abortion doctors) to delegate prescribing authority to pharmacists within the CPA, and according to the rules (protocols) they both agree to.

THE CPA IS THE WAY TO PHARMACIST ABORTIONS

What the courts have not done – bring pharmacists into the abortion business – HB 195’s Collaborative Practice Agreements (CPAs) can easily do.

There is no application, evaluation, or approval process for HB 195 CPAs – the abortion doctor and pharmacist write the agreement, and they’re in business!

HB 195 CPAs define the pharmacist’s scope of practice – literally, the pharmacist can do whatever he is capable and equipped to do.

And let’s be clear: if a nurse can diagnose a pregnancy over the phone or internet, then a doctor of pharmacy can learn to do the same at the pharmacy counter.

A Doctor of Pharmacy Can do in person what a nurse can do on the phone.

HB 195 CPAs are self-regulating.  The bill removes the State’s authority to regulate CPA’s in any way.

Finally, HB 195  is written so that there is no legal barrier to prescribing, administering, or dispensing abortion pills including mifepristone and misoprostol.

HB 195 defenders argue that the bill restricts prescriptions based on FDA REMS or drug manufacturer “certified training programs,” but no such restriction exists for mifepristone or misoprostol.

Put plainly: misoprostol is NOT FDA REMS or manufacturer regulated.

Mifepristone IS FDA REMS and manufacturer regulated.  But the neither FDA nor the manufacturers have any kind of “certified education program.”

HB 195 OPENS THE DOOR.

PLANNED PARENTHOOD TAKES THE DOOR OFF THE HINGES.

HB 195 CPAs open the door to pharmacist distributed abortion pills.  The Planned Parenthood takes the door off the hinges.

Legislators will vote to uphold or override HB 195’s veto soon.  There are no ‘passes’ for Republicans voting NO if the Governor’s veto is overridden.  Only together will republicans either win or lose the day.

A vote to override the Governor’s Veto is a vote supporting Planned Parenthood’s scheme of distributing abortion pills through Alaska’s pharmacies.
